Terms of Service

These Terms of Service (“Terms”) govern your access to and use of BRKT’s websites, apps, and related services (the “Service”) offered in connection with brkt.games. By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

BRKT provides online bracket and league features for tournaments (including World Cup 2026 style pools). Features, limits, and availability may change over time. We may suspend or discontinue parts of the Service with reasonable notice where practicable.

2. Eligibility and accounts

You must be old enough to form a binding contract where you live and meet any minimum age in our Privacy Policy. You are responsible for your account credentials and for activity under your account. Authentication and account security may be provided by Clerk; your use of Clerk is also subject to Clerk’s terms and privacy policy.

3. Your content

You retain rights to content you submit (“User Content”). You grant BRKT a non-exclusive, worldwide license to host, use, reproduce, display, and distribute User Content solely to operate, improve, and promote the Service. You represent that you have the rights needed to grant this license. We may remove content that violates these Terms or applicable law.

4. Acceptable use

You agree not to:

  • Use the Service unlawfully, fraudulently, or to harm others;
  • Attempt to gain unauthorized access to our systems, other users’ accounts, or data;
  • Interfere with or disrupt the Service, including by automated scraping that overloads our infrastructure without permission;
  • Circumvent payment, access, or usage limits;
  • Use the Service to distribute malware or spam.

5. Paid plans, billing, and taxes

Certain league tiers or features may require payment. Prices, features, and limits are shown at checkout or in the product. Payments are processed by Stripe. You authorize us and Stripe to charge your selected payment method for applicable fees.

Taxes. Where applicable, sales, VAT, GST, or similar taxes may be calculated and collected through Stripe (including Stripe Tax where enabled). You are responsible for any taxes not collected by us that apply to your purchase.

Currencies. Charges are displayed and processed in the currency shown at checkout unless otherwise stated.

6. Subscriptions, renewal, and cancellation

If a purchase is described as a subscription or recurring charge, it will renew according to the terms presented at purchase until you cancel. You can cancel as described in the product or through your payment provider where available. Cancellation stops future charges; it does not refund prior periods unless required by law or stated in these Terms.

When a paid period ends or is not renewed, paid features may revert to free-tier limits or become unavailable as described in the product.

7. Refunds and statutory rights

Unless otherwise required by law, all fees are non-refundable once paid. If you believe a charge was made in error, contact hello@brkt.games promptly with details.

EEA / UK consumers. If you qualify as a consumer under EU or UK consumer protection laws, you may have a statutory right to withdraw from certain distance contracts within 14 days unless you requested immediate performance and acknowledged that you may lose the withdrawal right once performance begins. Digital services that begin immediately may fall under those exceptions. Nothing in these Terms limits rights that cannot be limited by law.

8. Price changes

We may change prices for new purchases. For recurring subscriptions, we will provide reasonable advance notice of price changes as required by law and give you an opportunity to cancel before the new price takes effect.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BRKT AND ITS SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) FIFTY U.S. DOLLARS (USD $50).

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by applicable law.

11. Indemnity

You will defend and indemnify BRKT and its affiliates, officers, directors, employees, and contractors against any third-party claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your User Content, your use of the Service, or your violation of these Terms or law, except to the extent caused by our willful misconduct.

12. Dispute resolution and governing law

These Terms are governed by the laws of the State of Delaware, United States, excluding conflict of law rules, subject to mandatory consumer protections in the country where you reside that cannot be waived by contract.

Informal resolution: before filing a claim, contact hello@brkt.games and attempt to resolve the dispute in good faith.

Exclusive venue for permitted disputes: state or federal courts located in Delaware, USA, unless applicable law requires a different forum for consumers.

13. Changes to the Terms

We may modify these Terms. We will post the updated Terms on this page and update the “Last updated” date. If a change is material, we will provide additional notice as appropriate (for example, by email or in-product notice). Continued use after the effective date constitutes acceptance of the updated Terms, except where your consent is required by law.

14. Miscellaneous

  • Entire agreement. These Terms and policies referenced herein are the entire agreement between you and BRKT regarding the Service.
  • Severability. If a provision is unenforceable, the remaining provisions remain in effect.
  • No waiver. Failure to enforce a provision is not a waiver.
  • Assignment. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets.
